Rent to buy in Cyprus: what to check before you sign

· ACP LEGALS

Rent to buy combines a lease and a sale: the tenant lives in the property for an agreed period, the purchase price is fixed in advance and part of the rent is credited towards the price. In some contracts the tenant has a right to buy; in others an obligation to buy once certain conditions are met.

Why it is growing in Cyprus

High rents, difficult access to mortgages, large deposits and higher interest rates make rent to buy attractive for young couples, for people who do not meet the banks’ criteria, for foreign investors and for developers. It should not be confused with the state “Rent for Instalment” scheme for vulnerable borrowers with non-performing loans, which is legally different.

The biggest risk

Many tenants believe they have already secured the property. That is not automatically the case. Without proper legal protection, the owner can sell to a third party, register a mortgage or face creditors, and a buyer who has paid for years can be left with little real protection.

The legal framework

Cyprus has no specific law on rent to buy. Protection depends on how the contract is written and on existing laws: the Contract Law, the Sale of Land (Specific Performance) Law, the Immovable Property (Transfer and Mortgage) Law and the principles of equity.

Deposit at the Land Registry

Some contracts can be deposited at the Land Registry, which protects the buyer against a later sale, encumbrances or third-party claims. Many contracts, however, are not structured in a way that allows deposit. This must be checked before signing.

Checklist before you sign

  • Are there mortgages, encumbrances or prohibitions on the property?
  • Is there a separate title deed?
  • Can the contract be deposited at the Land Registry?
  • Exactly how is the rent credited towards the purchase price?
  • What are the conditions for exercising the right to buy?
  • What happens if a payment is late or missed?
  • How can the contract be ended, and what is refunded?
  • What are the tax and banking consequences?

Conclusion

Rent to buy can be a good solution, but only when the contract genuinely protects the buyer. A legal review before signing is essential.
